These Terms include a binding arbitration agreement and class-action waiver (Section 14). By using the Site or hiring us, you agree to resolve disputes through individual arbitration in North Carolina, not in court and not as part of a class action, except as described below.
1. Agreement to terms
These Terms of Service ("Terms") form a binding agreement between you and Right Electric LLC ("Right Electric," "we," "us," or "our"). They govern your use of therightelectric.com (the "Site"), our forms and embedded widgets, and any electrical services you hire us to perform unless a separately signed written contract says otherwise. If you do not agree to these Terms, do not use the Site or our services.
2. Who we are
Right Electric LLC is a licensed North Carolina electrical contractor based in Charlotte, North Carolina. Our work is performed under the license issued by the North Carolina State Board of Examiners of Electrical Contractors, and we carry liability insurance and bonding required for the work we take on.
3. Eligibility
You must be at least 18 years old and able to form a legally binding contract under the laws of North Carolina to use the Site or hire us. If you're using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Use of the Site
You agree not to:
- Use the Site in a way that violates any law or these Terms.
- Submit false, misleading, or impersonating information through any form.
- Attempt to probe, scan, or otherwise test the vulnerability of the Site or any related system.
- Interfere with or disrupt the Site, including by overloading it with automated requests.
- Scrape, frame, or republish the Site's content without our written permission.
- Use the Site to send spam, harvest contact info, or harass us or anyone else.
5. Estimates, quotes & scheduling
- Estimates are an opening figure.Any number we give you before we've seen the work in person is a planning estimate, not a binding quote. Pricing is finalized only after an on-site assessment.
- Quotes are valid for 30 days unless the quote itself says otherwise. Prices may change after that window or if conditions on site differ materially from what was described.
- Scheduling is on a first-come basis. A booked time slot is held when we confirm by phone, email, text, or written acceptance.
- Cancellations.Please give at least 24 hours' notice for residential service appointments and 72 hours for scheduled commercial work. We may charge a reasonable trip fee for missed appointments without notice.
6. Electrical services & scope of work
- Scope. The work we perform is limited to what is listed in the quote, work order, or signed contract for the specific job. Anything outside that scope is a change order.
- Code compliance. All work is performed to current North Carolina electrical code and standard industry practice. We do not warrant that pre-existing conditions on your property comply with code unless we specifically inspected and quoted that work.
- Permits and inspections. Where a permit is required, we pull the permit unless the contract assigns that responsibility to you. You grant us access to the property at reasonable times for the work and any inspection.
- Existing conditions. Buried or concealed conditions that could not reasonably have been anticipated may change the price or timeline. We will notify you before doing additional work that affects either.
7. Payments, deposits & change orders
- Deposits. Larger jobs may require a deposit before scheduling. Deposits are credited against the final invoice.
- Payment terms. Invoices are due on the terms stated on the invoice (typically due on receipt for residential service, Net 15 or Net 30 for commercial unless otherwise agreed).
- Change orders. Any change to scope, materials, or schedule after work has begun is documented in a written change order, signed or confirmed by text or email by both parties.
- Late payments.Past-due balances accrue a late fee of the lesser of 1.5% per month or the maximum permitted by North Carolina law. You are responsible for our reasonable collection costs, including attorneys' fees, on amounts properly owed.
- Liens. North Carolina law gives contractors lien rights on real property for unpaid work. We reserve those rights.
8. Warranty & limitations
We warrant our workmanship for one (1) year from the date of substantial completion, unless a different period is stated in writing for a specific job. Manufacturer warranties on materials and equipment pass through to you; we will help you make a claim under those warranties.
This workmanship warranty does not cover: damage caused by misuse, abuse, neglect, modifications by others, casualty events, power surges or utility faults, normal wear and tear, or work performed on systems outside the scope we installed.
EXCEPT AS EXPRESSLY STATED IN THIS SECTION, THE SITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, business interruption, or loss of goodwill — arising out of or related to the Site or our services, even if we have been advised of the possibility of those damages.
- Our total cumulative liability for any claim arising out of or related to the Site or our services will not exceed the greater of (a) the amount you actually paid us for the specific job that gave rise to the claim during the twelve (12) months preceding the event, or (b) one thousand U.S. dollars ($1,000).
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for gross negligence, fraud, or willful misconduct, or for personal injury caused by our negligence).
10. Indemnification
You will defend, indemnify, and hold harmless Right Electric, its owners, employees, and subcontractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your violation of any law or third-party right; or (c) your misuse of the Site.
11. Intellectual property
The Site, including its text, graphics, logos, photos, videos, and software, is owned by Right Electric LLC or its licensors and protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to view the Site for your personal, non-commercial use. All other rights are reserved.
You may not copy, modify, distribute, sell, or lease any part of the Site or our content without our written permission. Trademarks and service marks appearing on the Site are the property of their respective owners.
12. Third-party services
The Site embeds third-party services we use to run the business, including a chat widget and booking widget from LeadConnector / HighLevel and a database / hosting stack from Supabase and Vercel. Your interactions with those services may also be governed by their own terms and privacy policies. We are not responsible for the content or practices of any third-party site we link to.
13. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Subject to Section 14 (Arbitration), the state and federal courts located in Mecklenburg County, North Carolina have exclusive jurisdiction over any disputes that are not subject to arbitration.
14. Binding arbitration & class waiver
Read this section carefully — it affects how disputes are resolved.
You and Right Electricagree that any dispute, claim, or controversy arising out of or related to these Terms, the Site, or our services (a "Dispute") will be resolved by binding individual arbitration, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or Commercial Arbitration Rules if the customer is a business). The arbitration will be conducted in Charlotte, North Carolina, or by video at the parties' agreement.
Class-action waiver. Arbitration will take place on an individual basis. You and we waive any right to bring or participate in a class action, collective action, mass action, or consolidated proceeding.The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative proceeding.
Exceptions.Either party may bring a claim in small-claims court if it qualifies, may seek injunctive relief in court to protect intellectual property or confidential information, and may pursue mechanic's lien rights in court as provided by North Carolina law.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice to info@therightelectric.com within thirty (30) days after you first agree to these Terms, stating your name, contact information, and a clear statement that you opt out. Opting out does not affect any other part of these Terms.
If any part of this arbitration agreement is found unenforceable, the remainder remains in effect, except that if the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and brought in the courts identified in Section 13.
15. SMS messaging terms
When you give us a phone number, you authorize us to send you transactional and occasional marketing SMS messages. Message frequency varies; message and data rates may apply. Reply STOP to cancel and HELP for help. Full SMS terms are in our Privacy Policy.
16. Termination
We may suspend or end your access to the Site at any time, with or without notice, for any reason — including violation of these Terms. Either party may end a service engagement under the cancellation terms of the applicable quote or contract. Sections that by their nature should survive termination will survive, including Sections 8–14, 17, and 18.
17. Changes to these terms
We may update these Terms from time to time. When we do, we will update the "Effective" date at the top of this page. Your continued use of the Site after the update means you accept the revised Terms. Material changes to the arbitration section will be announced with a banner on the Site, and you will have a chance to opt out of the change.
